How does the 2018 Farm Bill define hemp? What does it mean for FDA-regulated products?
At the federal level, the Agriculture Improvement Act of 2018, Pub. L. 115-334, (the 2018 Farm Bill) was signed into law on Dec. 20, 2018. Among other things, this new law changes certain federal authorities relating to the production and marketing of hemp, defined as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.” These changes include removing hemp from the CSA, which means that cannabis plants and derivatives that contain no more than 0.3 percent THC on a dry weight basis are no longer controlled substances under federal law.
The 2018 Farm Bill, however, explicitly preserved FDA’s authority to regulate products containing cannabis or cannabis-derived compounds under the FDC Act and section 351 of the Public Health Service Act (PHS Act). FDA treats products containing cannabis or cannabis-derived compounds as it does any other FDA-regulated products — meaning they’re subject to the same authorities and requirements as FDA-regulated products containing any other substance. This is true regardless of whether the cannabis or cannabis-derived compounds are classified as hemp under the 2018 Farm Bill.

This is the 2nd Oz.of this strain The nugs are fresh and compact. The weight is always right on unless it seems a little stemmy. Only when heated or smoked does THCA convert to Δ9-THC — a process called decarboxylation.Yet despite that clear chemical distinction, enforcement agencies and politicians are once again blurring lines, threatening small hemp retailers and users with crackdowns — not because of illegal activity, but because of fear and politics.The hypocrisy, many say, is obvious. Alcohol, one of the most destructive substances in human history, is fully legal and widely sold in Pennsylvania. Law enforcement does not raid breweries or liquor stores when minors are caught drinking. Instead, those underage drinkers face the charges — and if they used fake identification, the blame is placed on them, not the business that followed the law.“For decades, judges have dismissed citations against store owners when a minor used a fake ID, because the responsibility lies with the underage offender,” says one local advocate. “That’s fair and reasonable — yet when it comes to THCA and hemp, the same principle is ignored.”Even though alcohol carries a staggering toll in drunk-driving deaths, liver disease, addiction, and family violence, lawmakers defend the right of adults to buy and consume it responsibly. Meanwhile, hemp and cannabis — substances with measurable medicinal benefit and minimal societal harm — are still treated like contraband.Unlike alcohol, which provides almost no therapeutic value outside of limited antiseptic use or as a minor anesthetic, cannabis has been shown to help manage chronic pain, anxiety, PTSD, and appetite loss, and to reduce reliance on more dangerous drugs such as opioids.Its non-psychoactive derivatives — including THCA — are part of a thriving industry built on plant-based wellness. For disabled adults, veterans, and retirees on fixed incomes, hemp-derived THCA offers accessible relief without the inflated prices of dispensary marijuana. > “A bottle of brandy may soothe a sore throat, but a small dose of THCA can calm the nerves, ease pain, and help you sleep — without the hangover, the addiction, or the liver damage,” notes one consumer advocate.Yet instead of recognizing this, many politicians are choosing to vilify the hemp industry — claiming that minors might misuse it, or that the chemistry is too confusing to regulate — even as they defend the far more dangerous alcohol industry.Selective Enforcement and Economic Reality In towns across Pennsylvania, mom-and-pop hemp retailers are being targeted not for selling to minors, but for carrying a product that meets federal standards and passes certified lab tests showing Δ9-THC under 0.3%. Owners describe being harassed, threatened with shutdowns, or accused of selling “marijuana” despite full compliance. The underlying motive, they believe, is money and control — from larger dispensary chains, political donors, and state tax structures that favor monopoly over local entrepreneurship. > “They’re squeezing out the small players,” one shop owner said. “All we want is the same fairness that alcohol sellers have — enforce the age limit, punish bad actors, and let adults make adult choices.”The Broader Social Context Since the end of alcohol prohibition, the U.S. has learned that banning substances doesn’t eliminate them — it only fuels black markets and criminalizes ordinary citizens. Cannabis prohibition followed the same path, and even today, the collateral damage remains: lives derailed, families broken, and prisons filled over a plant that has harmed far fewer people than legal alcohol ever has. The numbers tell the story. Alcohol contributes to over 140,000 deaths annually in the U.S. due to liver disease, accidents, and related causes. Cannabis-related deaths? Virtually none. So why, citizens ask, is the state cracking down on hemp instead of focusing on fentanyl, hard drugs, and the mental-health crisis plaguing communities? The Moral of the Matter Pennsylvania finds itself at a moral crossroads. The THCA debate is not just about chemistry or percentages — it’s about the principles of fairness, science, and adult freedom. If alcohol is allowed under regulation, then hemp and THCA deserve at least the same treatment, if not greater respect, given their far lower risk profile and medicinal promise. Adults should be trusted to make responsible choices. Minors should be protected and held accountable when they break the law. And small local businesses should not be crushed under the weight of political hypocrisy.The war on cannabis has lasted longer than Prohibition itself. And much like the repeal of the 18th Amendment, the end of this unjust double standard will come when enough citizens refuse to accept fear-based policymaking. Until then, responsible Pennsylvanians will continue to advocate for the obvious truth: a plant that heals should never be treated more harshly than a substance that kills.
